Built Different ("we", "us") provides web design, build, hosting and related services from Durham, England. These terms apply to all work we carry out and to your use of any website or service we provide. They apply to business customers. By engaging us or paying an invoice, you accept them. These terms prevail over any terms you put forward unless we agree otherwise in writing.
All quotes are fixed and provided in writing before work begins. The build fee is payable 50% on commencement and 50% before the site goes live, unless agreed otherwise in writing. The monthly fee begins the month the site goes live. We may charge statutory interest on overdue sums under the Late Payment of Commercial Debts (Interest) Act 1998.
Hosting, SSL certificates, daily backups, security patching, uptime monitoring and support as described in your package. It does not cover new pages, redesigns, features beyond your package, or recovery work arising from your own acts or omissions, which will be quoted separately.
We present the design before the build. If you do not wish to proceed after seeing the first design, you may cancel and pay nothing, and any deposit will be refunded in full. Once you approve the design and the build begins, the build fee becomes payable as set out above. The guarantee applies once per project and does not apply to bespoke work commissioned after a written specification has been agreed.
On full payment of the build fee, you own the website code, content and design produced for you. Your domain name is registered in your name and remains yours at all times. Third-party software, fonts, libraries and platforms remain subject to their own licences, which you agree to comply with.
You are solely responsible for the accuracy, legality and ownership of all content, data and instructions you supply, including text, images, prices, product claims, regulated-sector claims and customer data. You confirm you hold all necessary rights, licences and consents for material you provide. You are responsible for keeping your own copies of source materials supplied to us.
We apply reasonable, industry-standard security measures to websites we build and host, including SSL encryption, security patching and access controls. However, no website, server or system can be guaranteed to be secure, uninterrupted or free from vulnerabilities, and you acknowledge this. Provided we have exercised reasonable skill and care, we are not liable for loss or damage arising from unauthorised access, hacking, denial-of-service attacks, malware, or other malicious acts of third parties, nor for vulnerabilities in third-party software, platforms or services outside our control.
You are responsible for the security of credentials issued to you or your staff, for the security of your own devices, email and systems, and for promptly notifying us of any suspected compromise. We are not liable for loss arising from compromised client credentials or client-side systems. You are strongly advised to hold your own cyber and business insurance appropriate to your operations; our services are not a substitute for it.
We take automated daily backups of hosted sites and will use reasonable endeavours to restore the most recent viable backup in the event of data loss. Backups are a recovery measure, not a guarantee against all data loss, and we are not liable for loss of data that occurs despite our reasonable care, including transactions or content created between backup cycles.
We aim for high availability but do not guarantee that any website or service will be uninterrupted or error-free. Hosting depends on third-party infrastructure providers, and we are not liable for downtime, outages or failures originating with those providers, with domain registrars, or with the wider internet.
Websites may incorporate or depend on third-party services such as payment processors, booking engines, mapping, analytics or form-handling platforms. Those services are provided under their own terms, and we are not responsible for their performance, availability, pricing changes, security or withdrawal.
We build sites designed to perform, but we do not guarantee any particular search engine ranking, traffic level, conversion rate, enquiry volume or revenue outcome. Search engines and advertising platforms change their systems without notice, and results depend on factors outside our control, including your market, pricing and conduct.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded or limited. Subject to that: (a) we are not liable for loss of profits, revenue, business, anticipated savings, goodwill or data, or for any indirect or consequential loss, however arising; and (b) our total aggregate liability arising out of or in connection with our services, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the total fees paid by you to us in the 12 months immediately before the event giving rise to the claim.
You will indemnify us against claims, losses and costs arising from content or data you supply, your breach of these terms, your breach of applicable law including data protection and consumer law in your own trading, or your infringement of third-party rights.
Neither party is liable for failure or delay caused by events beyond its reasonable control, including internet or infrastructure failures, cyber attacks on third-party providers, power failures, industrial action, epidemics or acts of government. Obligations are suspended for the duration of the event.
You may cancel the monthly service with 30 days' written notice. On cancellation we will provide a full export of your website files and data within a reasonable period, subject to all sums due being paid. We may suspend service for non-payment after 14 days' written notice, and may terminate for material breach not remedied within 14 days of written notice.
Each party will comply with applicable UK data protection law. Where we process personal data on your behalf, we do so as processor under our GDPR Statement and any written processing terms agreed with you. You remain controller of, and responsible for, personal data collected through your website from your customers, including the lawfulness of its collection and use.
These terms, together with the written quote, form the entire agreement and supersede prior discussions. Variations must be agreed in writing. If any clause is found unenforceable, the remainder continues in force. Neither party may assign the agreement without the other's written consent, except that we may use subcontractors, for whom we remain responsible. No third party has rights under the Contracts (Rights of Third Parties) Act 1999.
These terms are governed by the law of England and Wales and subject to the exclusive jurisdiction of its courts.

When you submit an enquiry form on this website we collect your name, business name, email address, phone number if you provide it, and the details of your enquiry. We also collect basic technical data such as pages visited, in aggregate, to understand how the site is used.
We use enquiry data to respond to you, prepare your quote and deliver our services. Our lawful basis is legitimate interest in responding to enquiries you have chosen to send, and performance of a contract once you engage us.
Form submissions are processed by Netlify, our website platform, and delivered to our email. We do not sell your data, share it with third parties for marketing, or use it for anything beyond handling your enquiry and providing our services.
Enquiry data is kept for 12 months from your last contact, then deleted, unless you become a client, in which case it is kept for the duration of our relationship plus 6 years for legal and accounting purposes.
Under UK data protection law you have the right to access, correct, delete or restrict the use of your personal data, and to object to its processing. To exercise any of these rights, email hello@wearebuiltdifferent.co.uk. You also have the right to complain to the Information Commissioner's Office at ico.org.uk.
This website does not set marketing or tracking cookies. Any essential cookies are used solely to make the site function.

For enquiries made through this website, we are the data controller. We collect only what we need, use it only for the purpose you gave it, store it securely on UK or EU-based systems, and delete it when it is no longer required, as set out in our Privacy Policy.
Every website we build is designed to UK GDPR standards: lawful cookie consent where required, clear privacy notices, secure SSL-encrypted forms, and data capture limited to what the business genuinely needs. Where we host and process data on behalf of a client, we act as a data processor under a written agreement.
Websites we host use SSL encryption as standard, are backed up daily, and receive ongoing security patching. Access to client data is restricted to those who need it to do their job.
In the unlikely event of a personal data breach, we will assess and contain it immediately, notify affected clients without undue delay, and report to the Information Commissioner's Office within 72 hours where required by law.
